By accessing or using the Kernel Agents website (the “Site”), you agree to these Terms of Service. If you do not agree, do not use the Site.
The Site
The Site provides general information about our services. It does not create a client relationship. Custom engineering, cloud deployments, and professional services are governed only by a separate written agreement between you and us.
Acceptable use
You agree not to misuse the Site—for example, by attempting unauthorized access, disrupting service, or using automated means to scrape or overload the Site in a way that harms us or other users.
Intellectual property
Content on the Site (text, graphics, logos, and layout) is owned by Kernel Agents or our licensors and is protected by applicable laws. You may not copy or reuse it for commercial purposes without our written permission, except as allowed by law (such as fair use).
Third-party links
The Site may link to third-party sites (for example calendar booking). We are not responsible for their content or practices. Your use of third-party services is between you and them.
Disclaimers
The Site and its content are provided “as is” and “as available.” We disclaim warranties to the fullest extent permitted by law, including implied warranties of merchantability and fitness for a particular purpose. Information on the Site may change; we do not guarantee it is complete or current.
Limitation of liability
To the fullest extent permitted by law, Kernel Agents and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits or data, arising from your use of the Site. Our total liability for any claim related to the Site is limited to the greater of (a) one hundred U.S. dollars or (b) the amount you paid us in the twelve months before the claim for services directly tied to that claim—unless applicable law requires otherwise.
Indemnity
You agree to defend and indemnify Kernel Agents against claims arising from your violation of these terms or misuse of the Site, to the extent permitted by law.
Governing law
These terms are governed by the laws of the United States and the State of Delaware, excluding conflict of law rules. Courts in Delaware have exclusive jurisdiction for disputes arising from these terms or the Site, unless a different forum is required by mandatory law where you live.
Changes
We may update these terms by posting a new version on the Site. The “Last updated” date will change. Continued use after changes constitutes acceptance. If you disagree, stop using the Site.
